Real Estate Market Brief

February 26, 2026

Today: FinCEN's new residential real estate reporting rule takes effect with implications for all-cash transactions, while short-term rental insurance gaps remain a critical liability exposure for landlords converting long-term inventory.

Property Management & Rentals

Short-term rental insurance coverage gaps require immediate portfolio review. Standard landlord policies don't cover STR operations, creating significant liability exposure for any property you're managing or advising on that's been converted to Airbnb/VRBO. If you have clients running student housing as STRs near UGA (common for football weekends or parent visit periods), they need specialized STR policies or commercial coverage. The risk isn't theoretical: a slip-and-fall or property damage claim on a traditional landlord policy will get denied, leaving the owner personally exposed. Action item: audit any managed properties doing short-term rentals and require proof of proper coverage or conversion back to long-term leases. Source

Commercial & Investment

Cash offer financing structures can help buyers compete without tying up capital. The trend of "cash offer" programs (where a lender provides short-term cash backing for the offer, then converts to permanent financing post-closing) is gaining traction. This matters in Athens when your investor clients are competing against out-of-state buyers on student housing multifamily deals. A financed buyer who can present as cash gets the seller's attention and avoids appraisal/financing contingencies that kill deals. Look at programs like Dominion Financial's cash offer product for buyers who need speed but don't want to liquidate stocks or pull from other deals. Not a fit for every transaction, but worth knowing when you're representing buyers in competitive situations. Source

Industry & Legal

FinCEN residential real estate transparency rule is now active. NAR published FAQs on the new federal anti-money laundering reporting requirements for all-cash residential transactions. This affects your practice if you're handling cash deals, particularly on investment properties or foreign buyer transactions. The rule requires disclosure of beneficial ownership information for certain all-cash purchases to combat shell company abuse. You need to understand which transactions trigger reporting, what information must be collected, and how to communicate this to cash buyers without killing deals. Expect friction and questions from clients who don't want to disclose entity structures. Get the NAR FAQ doc and review with your broker or attorney to ensure compliance on current and future cash transactions. Source
